Abstract

This article discusses the European Union's internal rule of law promotion strategy following Poland's 2015 judicial reforms. It first lays out Harold Koh's "transnational legal process theory" and its power to explain compliance in international law. From this theoretical backdrop, it surveys the rule of law promotion literature on norm diffusion and offers explanations as to why the European Union's attempts to elicit reforms in Poland have been unsuccessful thus far.
